2.2. The WYRE Service is a platform for professional transfer of photos from cameras, designed primarily for photographers, events, and media teams.

3.1. Customer – a natural or legal person who has registered a user account or ordered a subscription to the Service.

3.2. Service – the WYRE platform including features for transferring, managing, and sharing photos.

3.3. Subscription – an annual or monthly right to use the Service, which automatically renews for another period of the same length unless the Customer cancels it before the renewal date.

3.4. User Account – an account created by registration through which the Customer accesses the Service.

3.5. Paddle – Paddle.com Market Limited, the Provider's authorised reseller and Merchant of Record for orders placed at wyreimg.com.

4. Registration and User Account

4.1. Registration of a user account is required to use the Service. The Customer is obliged to provide true and complete information.

4.2. The Customer is responsible for securing their login credentials and for all activity carried out through their account.

4.3. The Provider reserves the right to delete user accounts that have been inactive for more than 12 months, or accounts that violate these Terms or applicable law.

4.4. The Customer may cancel their account at any time via the settings in the user interface or by sending a request to the Provider's email.

5. Ordering and Payment

5.1. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

5.2. Orders are also subject to the Paddle Buyer Terms. Paddle processes the payment, collects any applicable sales tax or VAT and issues the receipt or invoice for each payment.

5.3. Prices and the scope of individual plans are listed on the Pricing page in euros (EUR) or US dollars (USD). Applicable taxes are calculated according to the Customer's location and shown before payment.

5.4. The Service is provided on an annual or monthly subscription basis; the Customer chooses the period when ordering. The subscription renews automatically for another period of the same length and is charged to the payment method stored by Paddle. The Provider has no access to the Customer's card details.

5.5. The Customer may cancel automatic renewal at any time in their account settings. After cancellation, the subscription remains active until the end of the current paid period.

5.6. The Provider is entitled to change prices; any change takes effect from the first renewal after the expiry of a 30-day notice period. The Customer will be notified of any price change by email at least 30 days in advance.

5.7. The Service is provided online. The subscription is activated immediately after the payment is confirmed and the Customer can create a gallery in their account settings right away.

06

6. Trial Period

6.1. If a free trial is offered, its length and conditions are shown on the Pricing page and at checkout before the order is placed.

6.2. A trial may only be used once per user account.

07

7. Cancellation, Refunds and Withdrawal

7.1. The Customer may cancel the subscription at any time in their account settings or by sending an email to the Provider. Cancellation takes effect at the end of the current paid period; until then, the Customer retains full access to the Service.

7.2. Refunds: the Customer may request a full refund within 14 days of the first payment of a subscription. Refunds are processed by Paddle; the Customer can request one by email to the Provider or through paddle.net.

7.3. A Customer who is a consumer may also have a statutory right to withdraw from the contract under the law of their country of residence. Nothing in these Terms limits such mandatory rights.

7.4. Pro-rated refunds for unused portions of a subscription are not provided, except as required by law or stated in art. 7.2.

7.5. The Provider reserves the right to terminate the provision of the Service to the Customer in the event of a serious breach of these Terms. In such a case, the Customer is not entitled to a refund of payments made.

7.6. After the subscription ends, the Customer's data (galleries, uploaded photos and files) will be retained for 90 days. After this period, all data will be permanently and irreversibly deleted. The Customer is responsible for backing up their data before the subscription ends.

9.2. The Customer must not:

  • grant access to their account to third parties beyond the permissions of their selected plan;
  • attempt to gain unauthorized access to the Provider's systems;
  • use the Service to store or distribute content that violates applicable law;

  • copy, modify, or reverse-engineer the software constituting the Service.

9.3. The Customer is fully responsible for the content (photos and data) that they upload and process through the Service.

10. Provider Liability

10.1. The Provider is liable for the proper provision of the Service in accordance with these Terms.

10.2. The Provider is not liable for damages resulting from:

  • outages caused by force majeure or circumstances beyond the Provider's control;
  • improper use of the Service by the Customer;
  • data loss caused by circumstances on the Customer's side;
  • unauthorized access to the Customer's account due to inadequate protection of login credentials.

10.3. To the extent permitted by law, the Provider's total liability for damages arising in connection with the provision of the Service is limited to the amount of payments made by the Customer in the preceding 12 months.

13

13. Final Provisions

13.1. These Terms and the relationship between the Provider and the Customer are governed by the laws of the Czech Republic. If the Customer is a consumer, this choice of law does not deprive them of the protection of mandatory provisions of the law of their country of residence.

13.2. The Provider is entitled to amend these Terms. The Customer will be notified of any changes by email or a notice in the web interface at least 30 days before the new Terms take effect. If the Customer disagrees with the changes, they may cancel their subscription before the end of the current billing period.

13.3. If any provision of these Terms is invalid or ineffective, the validity of the remaining provisions shall not be affected.

13.4. All communication between the Provider and the Customer shall be electronic, via email or the web interface.
